Terms of Service

1. Acceptance of Terms
By accessing or using the Tree Traction website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms apply to all visitors, users, and clients of Tree Traction.
2. Services
Tree Traction provides direct mail marketing services exclusively for tree service companies. Our services include neighborhood targeting and analysis, custom mailer design, printing and distribution via USPS Every Door Direct Mail (EDDM), route-level call tracking, campaign performance reporting, and dedicated account management.
3. Payment Terms
All services are billed on a monthly basis. The initial service agreement is a three-month commitment. After the initial three-month period, the agreement continues on a month-to-month basis. Cancellation requires 30 days written notice to support@treetraction.com. Pricing is based on volume and is agreed upon prior to campaign launch.
4. Intellectual Property
Client data, tracking phone numbers, campaign performance data, and route-level insights belong to the client. Clients retain full ownership of all data generated through their campaigns. Tree Traction retains ownership of its proprietary targeting algorithms, satellite imaging technology, software platform, and internal systems. Mailer designs created by Tree Traction for a client are licensed for the client's exclusive use during the term of service.
5. Client Responsibilities
Clients are responsible for providing accurate business information, responding to account manager communications in a timely manner, approving mailer designs before distribution, and maintaining the ability to handle incoming call volume generated by campaigns.
6. Limitation of Liability
Tree Traction shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use our services. Our total liability shall not exceed the amount paid by the client in the three months preceding the claim. Tree Traction does not guarantee specific revenue outcomes, though we stand behind our performance guarantee as described on our website.
7. Termination
Either party may terminate this agreement after the initial three-month period with 30 days written notice. Tree Traction reserves the right to terminate service immediately if a client engages in fraudulent activity, violates these terms, or fails to make timely payments. Upon termination, clients retain ownership of all their data and tracking numbers.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in Utah County, Utah.
9. Changes to Terms
Tree Traction reserves the right to update these Terms of Service at any time. Clients will be notified of material changes via email. Continued use of our services after changes constitutes acceptance of the updated terms.
